Section 1 - Scope

These Terms of Service (hereinafter "Terms") apply to all contracts concluded via the online shop TORIS (torisback.com) between the operator Victoria Wojciechowska, Kruszowice 16, 56-420 Bierutów, Dolnośląskie, Poland (NIP: 9112058630) - hereinafter "Seller" - and the customer.

Our services are provided via the e-commerce platform Shopify.

These Terms apply exclusively. Any deviating terms of the customer will not be recognized unless the Seller expressly agrees to their validity in writing.

Section 2 - Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to submit an offer. By clicking the order button, you submit a binding offer to purchase. The order confirmation by email constitutes acceptance of the offer.

We reserve the right to reject orders for objective reasons. All product descriptions, images and prices may be changed without prior notice.

Section 3 - Prices and Payment

All prices include statutory VAT. Shipping costs are stated separately during the order process and displayed before you submit your order. There are no hidden fees.

Payment is made via the payment methods offered in the shop. All payments are processed securely via SSL-protected pages. You agree to provide correct and complete payment information.

Section 4 - Delivery and Shipping

Delivery is made to the delivery address provided by the customer. Details on shipping methods, delivery times and costs can be found in our Shipping Policy.

Delivery times are estimates and not guaranteed dates. We are not liable for delays caused by shipping carriers, customs clearance, weather events or other circumstances beyond our control.

Section 5 - Right of Withdrawal

As a consumer within the EU, you have a statutory right of withdrawal of 14 days. Please refer to our withdrawal instructions in the separate Return Policy for details. In addition, we voluntarily offer an extended return period of 30 days.

Section 6 - Retention of Title

The delivered goods remain the property of the Seller until full payment has been made.

Section 7 - Warranty for Defects

The statutory warranty rights apply. In the case of defective goods, you are entitled to subsequent performance (repair or replacement). If subsequent performance is impossible or disproportionate, you may withdraw from the contract or reduce the purchase price. The warranty period is 2 years from delivery.

Section 8 - Limitation of Liability

We are liable without limitation for damages arising from injury to life, body or health, as well as for damages caused intentionally or by gross negligence. Otherwise, we are only liable in the event of a breach of essential contractual obligations, whereby liability is limited to the foreseeable damage typical for the contract.

The above limitation of liability does not apply where mandatory statutory liability provisions take precedence.

Section 9 - Our Products

We strive to present our products accurately. Colors and appearance may vary depending on the device and screen settings. We reserve the right to discontinue products at any time and to limit order quantities.

Section 10 - Intellectual Property

All content of our services - including texts, images, graphics, logos and designs - is our property or that of our licensors and is protected by copyright. Reproduction, distribution or use without our written consent is not permitted.

Section 11 - Terms of Use

The use of our services is permitted only for lawful purposes. The following are prohibited in particular: use for unlawful purposes, infringement of third-party rights, transmission of malware and the collection of personal data of other users.

Section 13 - Relationship with Shopify

TORIS is operated via Shopify. However, all purchases and sales are concluded directly with Victoria Wojciechowska (TORIS). Shopify is not responsible for transactions between you and us.

Section 14 - Applicable Law and Jurisdiction

The law of the Republic of Poland applies to all legal relationships between us and the customer, taking into account the mandatory consumer protection provisions of the country in which the customer has their habitual residence.

For consumers within the EU: The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless legally required to do so.

Section 15 - Severability Clause

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.

Section 16 - Changes to the Terms

We reserve the right to update these Terms at any time. Changes will be published on this page. Continued use of our services constitutes acceptance of the updated Terms.
